Terms and Conditions

The Contract for a rental shall be made between “The Hirer” and “The Owners” of “Rushop Hall” and the Contract shall be governed by UK Law.

Terminology

“Hirer” is the person booking the accommodation on behalf of the persons intending staying.

“Owners” refers to Jan and Neil Allcock who own the “Partnership” known as “Rushop Hall”.

Breakfast and packed lunches are available to all of our guests and can be added to the reservation. Breakfasts are included in the room price for the B&B guest rooms, but are not included in the price of the self-contained cottages. Packed lunches are not included in the price for any accommodation type.

Location of Rushop Hall

Rushop Hall is situated approximately equidistant between Chapel-en-le-Frith and Castleton just off Sheffield Road, on Rushup Lane. Satellite Navigation will not take you directly to Rushop Hall but to Coldwall Farm, a neighbouring farm that shares our post code so please use the local directions provided on the website or contact us for instructions.

Duration and Times of Rental

The Hirer and guests can arrive between 4.00 pm – 10.00pm on the day or arrival and must vacate the premises by 10.00 am on the day of departure.

A mimium stay applies to some accommodation types. See the accommodation descriptions for which rules apply.

Deposit and final payment

All bookings must be made by people aged 18 years or over. No booking is confirmed until a deposit of 50% of the accommodation cost has been received. The contract is with the named lead person and it is the responsibility of this person to ensure that all members of the party are notified of, and conform to, our terms and conditions.

For online bookings we accept secure online credit card payments via Stripe. We can also accept BACS bank transfer and payment on arrival – please contact us if you are unable to pay online. The remaining 50% accommodation balance will be due 4 weeks (28 days) before the check-in date.

Rushop Hall reserves the right to cancel a reservation where full payment has not been received less than twenty-eight days before the holiday commencement date. For late bookings (within 4 weeks of the check-in date) full payment is required at the time of booking.

The price includes heating, electricity, bed linen and towels. Where appropriate tea towels, basic cleaning materials, washing up liquid, dishwasher tablets and initial supply of wood for the wood burning stove will be provided.

If a travel cot or high chair is required then you must request this on the reservation form or by email in advance and provide your own bedding for the cot.

Corona Virus Policy

In the event of a travel ban or lockdown (either where you live or at Rushop Hall) due to COVID-19 then we will refund all money paid to us or allow you to re-book an alternative date.

In accordance with COVID-19 guidance to protect our cleaning staff where relevant please place all bedding and towels in the laundry bag provided.

Insurance

At the point that Rushop Hall has received the required deposit to secure your booking, a legally binding contract exists between The Hirer and Rushop Hall that is non-cancellable and non-refundable. We strongly advise you to take out cancellation insurance to offset any potential loss due to an unforeseen cancellation. Clients are recommended to have insurance to cover cancellation and/or curtailment of the holiday, and loss of baggage, personal effects and money.

Cancellation of accommodation

If you wish to cancel the booking for any reason it is important that you advise us at Rushop Hall by email at the first opportunity so that we may re-let your accommodation and minimize your financial loss. We will use our best endeavours to obtain a replacement booking and, if such a replacement is obtained, will then refund to the Hirer any monies paid less a handling charge. If we are unable to re-let the property then we shall be entitled to retain all payments already made.

Applicable to all bookings

You may not transfer your booking to anyone else without prior consent.

Following your booking, in the unlikely event of your accommodation becoming unavailable due to circumstances outside our control, every effort will be made to provide alternative accommodation at Rushop Hall or nearby accommodation, or alternatively a complete refund will be paid including the deposit.

The Owners do not accept responsibility for breakdown in public or local supplies, including water or electricity, nor any claims against inconvenience caused by such incidences, or by building works that may be deemed as necessary.

In the case of any breakdown Guests are asked to notify the Owners immediately. We will, in conjunction with the service company concerned, try to correct the fault as soon as possible.

In the event of a national or local disease epidemic, whether human or animal, the Owners reserve the right to cancel any booking at any time.

The Owners retain the right to refuse to hand over the accommodation to a Guest, or repossess accommodation if it is reasonably believed that any damage is likely to be caused.

The Owners can also repossess the accommodation if damage has already been caused. No refunds will be given in these circumstances. We reserve the right to claim for any damage at the property or to any of its contents.

Changing a Booking

Rushop Hall cannot guarantee to change previously booked dates but we will use our best endeavours to do so.

Your Safety

Every reasonable effort has been made ensure your safety. However, it is Guests’ responsibility (particularly parents with young children) to inspect the property and grounds immediately on arrival and note any possible hazards. Check the layout of your holiday property so that in an emergency you can get out quickly and easily.

The use of accommodation and amenities, where offered, is entirely at the user’s risk, and no responsibility can be accepted for injury, or loss or damage to user’s or visitor’s belongings.
Guests must accept responsibility for the safety of their children; no child may go into the pond areas unaccompanied.

As a fire precaution, use of candles is not permitted inside the accommodation and only wood should be used in the wood burning stoves.

Rushop Hall has a no smoking policy inside all accommodation (including e-cigarettes). A cleaning fee of £250 will be charged if a guest ignores this. We reserve the right to pass on any additional costs arising from lost bookings due to smoke contamination.

Smoking is prohibited in and around the site and barns but is allowed outside the accommodation providing cigarette ends are disposed of in a bin once fully extinguished.

Deep fat fryers and chip pans are not permitted anywhere in the accommodation.

Children are not allowed to wander around the site unsupervised. Rushop Hall is a place of work and can be very dangerous; watch out for vehicles, tractors and animals being moved in and around the site; animals can be unpredictable. For personal safety it is especially important that children do not climb on any of the stone walls.

Guests may be asked to leave immediately if their conduct is considered to infringe the Owners’ Terms and Conditions/rules or is likely to impair the enjoyment, comfort or safety of other guests and/or staff. No refunds will be given in these circumstances.

If Guests or any member of their party, including animals, has or has just had an infectious or contagious medical condition the Owners have the right to refuse the booking, cancel the stay or ask the Guest to leave Rushop Hall immediately should it be considered necessary, to protect the health of other guests and/or staff.

The Owners should be informed immediately should any condition develop within four weeks of arrival date, or during the stay at Rushop Hall.

Guests may not bring any personal shotgun, air rifle, crossbow or firearms to Rushop Hall under any circumstances or for any reason whatsoever. The use of drones and fireworks are not allowed without our express written permission. Sky Lanterns are expressly forbidden.

General

The number of persons occupying the accommodation must not exceed that stated at the time of booking, unless agreed previously with the Owners. Sub-letting is strictly prohibited.
Day visitors are permitted, but to preserve the peaceful surroundings for other guests, are limited to 4 per day unless otherwise agreed with management beforehand. Any day visitors must not use the facilities and must leave the site by 11.00 pm.

The Owners cannot accept responsibility or liability for loss or damage to Guests’ property, for personal or horse injury, or damage to bicycles, cars or horseboxes/trailers kept at Rushop Hall.

The Owners reserve the right to have access to accommodation at all reasonable times without permission. Prior notice will be given to Guests whenever possible.

The Owners endeavour to maintain high standards of comfort and cleanliness at all times. The Guest must therefore undertake to keep all furniture, fittings and effects in the same good condition as found. If extra cleaning is required after departure it will be charged to the Guest.

All damage must be reported to the Owners as soon as possible. Accidental damage or breakage of a minor nature will not normally be charged for, but the Owners reserve the right to charge for any non-trivial damage, losses or additional cleaning required howsoever caused. Immediate payment from the Guest is required to cover any such costs.

Mobile phone reception is variable depending upon the service provider. No medical facilities are available on site. In case of emergency there is a telephone in the main house.

Free Wi-Fi is available, but is not 100% guaranteed due to our location.

Discounts

Rushop Hall reserves the right to change any offers published on the website at any time.
We actively encourage couples and small families to enjoy our larger cottages by offering substantial ‘small group’ discounts throughout the year.

Price Changes

We reserve the right to amend or change prices at any time.

Value Added Tax (VAT)

All prices are including 20% VAT.

Liability

Rushop Hall, its employees and agents does not accept third party liability in respect of breach of contract, negligence, misrepresentation or otherwise.

We will not be liable or responsible for any failure to perform, or for any delay in performance of, any of our obligations under the Contract that is caused by any act or event beyond our reasonable control (Force Majeure Event, Pandemic or Epidemic).

Brochure and Website Descriptions

Information contained on our website is related to places such as towns, shops, and public houses that are not related to Rushop Hall. Closure or changes to these facilities are outside of our control but we will endeavour to keep the information contained in this website up-to-date.

Pets

We do accept well-behaved pets into our cottages and into Boots and Bridles but insist that they are kept off the furniture, beds and chairs and not left in the cottage unattended. Any damage or additional cleaning caused by your pet must be paid for and for this reason we strongly recommend that you bring a cage with you for your pet. Pets must always be kept under control, particularly around the site and other animals. Failure to meet this condition will be treated as “cancellation”. It is the pet owner’s responsibility to clear up all fouling immediately.

Horses

When bringing horses you may arrive earlier in the day to ride, sort out your tack and settle your horse in the grazing paddocks, although access to your accommodation and stables if required will not usually be possible until 4.00 pm.

Christmas and New Year Festivities

Our accommodation is available throughout the year. At Christmas we provide complimentary decorations. If these are not required, please request this by email in advance.

Breach of Contract

If there shall be a breach of any of these conditions on the part of the Hirer or any member of the party the Owners and the Agents reserve the right to re-enter the property and terminate the accommodation letting without prejudice to the other rights and remedies of the Owners.

Complaints

Every effort has been made to ensure that you have an enjoyable and memorable stay at Rushop Hall. If however, you have any cause for complaint we are anxious that remedial action is taken as soon as possible. It is essential that you contact us immediately if any problem arises so that it can be speedily resolved. Discussion with us whilst you are in residence usually enables shortcomings to be rectified straight away. If after this you feel that the complaint still remains unresolved then notify us in writing within 7 days of returning from your holiday. Please help us to help you by following this procedure. It is designed to effect the quickest possible investigation and rectification of complaints. We cannot subsequently consider any complaints or enter into any correspondence about them unless this procedure has been followed.

Your Rights

Your statutory rights are not affected by anything contained within these Terms and Conditions.

The Hirer and Guest Obligations

The Hirer agrees:

  • That the Owners can access the property as and when they deem necessary.
  • To pay for breakages, losses or damage to the property or its contents before departure.
  • Not to sublet or share the property except with persons nominated when booking. The maximum number of persons allowed at the property is clearly stated and must not be exceeded. Rushop Hall reserves the right to terminate the hire without notice and without refund in case of a breach of these conditions and it will be treated as a cancellation by the Hirer. In these situations no refund of any monies paid in respect of your booking will be made and neither the Owners nor The Partnership will have any liability to you as a result of this situation arising. Neither the Owners nor The Partnership will be obliged to find any alternative accommodation for you.
  • That you and all members of your party will take all reasonable care of the accommodation and keep it clean and tidy and leave the it in a similar condition to which you found it upon your arrival.
  • To be responsible for any additional cleaning costs incurred as a result of the clause above.
